User Agreement

Hello and welcome to BidsnBuys User Agreement, this agreement describes the terms

And conditions that apply to you the user. The terms and conditions must be read and agreed

With before you may become a registered user of the site BidsnBuys.

We retain the right to amend the BidsnBuys user agreement giving notice on our site.

Any amendments to the User Agreement will over rule the existing agreement and will govern old and new users of the site BidsnBuys.

1. Eligibility of Membership for the site BidsnBuys.

This site cannot be used by anyone under the age of 18 years of age, or anyone who

2. Verification of Identity

We have a feed back rating system in operation which will help you assess the user that you are dealing with.

3. Legal Responsibility.

If at any time you have reason to take action or make a legal claim against any other user of the site BidsnBuys it must be agreed by you to take up any rights that you may have legally, by yourself and you release BidsnBuys and any employees, directors, officers, agents and affiliates, from all claims, damages, liability, losses, expenses and costs. This includes legal fees, unknown and known, which arise from or are in any way linked with claims, actions or rights.

4. About Selling and Listing.

Description of your listing. Sellers must make certain that they are lawfully entitled to sell every item they list on the site and it is legal to sell in the United Kingdom and overseas, and that it is legal to export the item that has been sold to a person resident in the buyer�s province. On the listings page of the site you must give a description of your item, these can only consist of graphics, descriptions, pictures and other subject matter significant to the sale of the item you are selling and the responsibility is yours for making certain that you have the entitlement to use all the subject matter in your listings and Bidsnbuys have the right to put it on our servers. The appropriate category must be used for all items listed. Multiple item listing or Dutch auction all items must be the same.

5. Deception and Fraud

If it is believed at any time you have taken part in fraudulent activities or are about to take part in fraudulent activities or you have been in any way been implicated in deception or fraud linking to the site BidsnBuys your account will be closed.

6. Influencing the price of an item.

At no time must the price of an item be influenced or manipulated and the interference of another users listing is strictly forbidden. At no time must you bid on an item that you are selling or get someone else to bid for you. You are restricted from getting in touch with bidders where items are offered for sale in order to put forward items that are alike to the bidders who are in that listing.

7. BidsnBuys Fees.

To join BidsnBuys and to bid on any item listed is free, but the responsibility of the costs to access the BidsnBuys site and to correspond with other users is yours. Fees are charged for having items listed for sale on this site. When an item is listed you will have the chance to check and understand the prices you will be charged. There is a fee charged when you list any items to bid on or for sale and the fees are explained in the BidsnBuys Procedure of Fees which this user agreement is a section of.

We reserve the right to alter the Procedure of Fees at any given time by giving an announcement on the BidsnBuys site which will be in force two weeks after the announcement is made. We reserve the right to make short term changes for such events as days were there are no charge for listing you item and other similar promotions. At any time we have the right to launch new categories to our site and the fees will be in force at the introduction of the new service.

All fees are to be paid in GB Pounds Sterling, unless stated otherwise. VAT and other taxes may be relevant to your business deal regardless of whether you are a business or not. If you are a seller the responsibility for the payment of all fees connected to using the site BidsnBuys and all the taxes that are relevant are yours. You must be of the understanding that you could be given invoices by email.

1. 8. Boundaries and Restrictions.

There are boundaries and restrictions you must abide by when you become a user of this site at no time the information you give will be,

1. a. Untruthful, incorrect, or deceptive
2. b. Insulting, intimidating, obnoxious, derogatory or in breach of any rights including copyright.
3. c. Violate the exclusive rights of any third party including trademark, copyright, patent, or any other ownership rights.
4. d. Or be deceptive or in any way engage in the transaction of imitation or contraband goods.
5. e. Or to violate any regulations or laws that apply, these include misleading advertising, against prejudice, the control of export, the protection rights of the consumer, but not just restricted to these.
6. f. Or to be indecent or include pornography involving children.
7. g. Or make us accountable or instigate us to lose partly or fully our contractors and our IPS s and anyone else who supplies us.
8. h. In any way connect us to either directly or indirectly or to contain accounts of items or services that this user agreement has forbidden or are the same as other goods you are selling, but you have valued less than the reserve or minimum bid total. Or if you are selling the item on another site that is not BidsnBuys although you may still promote a BidsnBuys item from a different site. Or have any rights to enter anything that has Trojan horses, computer viruses, worms, macro viruses that in anyway are intended to impede with, or stop the usual functioning actions of the computer, or to underhandedly stop admittance without authorization or to confiscate any personal data or information. Or in any way instigate the site BidsnBuys to be obstructed, stopped, disabled, and made less competent impairing the operation of the site.

At no time must any item be listed on the sit BidsnBuys or conclude any business deal instigated on the site BidsnBuys so by disbursing to us the fee payable for listing or the ending price would bring about BidsnBuys to breach any appropriate regulation or our terms in Restricted Items.

9. Other Users Data and how to you must Use it.

Sellers have the right to use the user email address and ID and any details given for contact information of the successful buyer or bidder, and the successful buyer or bidder has the right to access the email address, ID and the information given for contact details of the person selling the item.

10. Admittance and Intrusion.

It is agreed by you that you do not use any mechanical process to enter the BidsnBuys site for any reason; this includes spider, robot, and scraper if you do not have conveyed on paper our authorisation. Also it is agreed by you that at no time will you take any proceedings that will inflict or could inflict in our judgement an awkward or excessively substantial burden on the BidsnBuys communications. Or duplicate, replicate, adapt or produce copied works, circulate or openly exhibit any subject matter apart from your data from the BidsnBuys site unless you have previous written consent from Bidsn Buys, or any other party that it relates to. Or obstruct or try to obstruct with the running of the BidsnBuys site, or anything that may be happening on the site, or interfering with anything we have used to stop admittance to the BidsnBuys site. Never at anytime do we give permission to remove or reuse sizeable parts of the site BidsnBuys.

By agreeing to the BidsnBuys user agreement, you have accepted that with consideration to other users data that you have acquired from the site that the information may only be used for contact of BidsnBuys related matters that connect to your sincere involvement in a business deal made possible on the BidsnBuys site. And the information may only be used for grievances and deception complaints. This site and its users will not put up with spam or unwanted advertising. At no time shall you add a BidsnBuys user to your correspondence list, even if they have bought an item from you. If you need to inform spam from other users of BidsnBuys send an email report to BidsnBuys Panel of Protection and Security.

11.Violation.

If found in violation we may restrict your use of our site by instantly distributing a caution or postponing or ending your registration as a user or items you may have listed and without notice decline our services to you as a user. If at any time you are found to be in violation of the BidsnBuys user agreement and if any data you have given to BidsnBuys is not able to be confirmed and if your dealings could bring about any monetary losses or lawful charge.

12. BidsnBuys Feedback System. At no time must you undermine the reliability of the BidsnBuys feed back system. We reserve the right to limit the amount of listings and bids that are placed on the site at any one time by the user, according to the level of your feedback. If at any time your rating drops to -2 then you will be suspended from the site. Any feedback rating must not be used at any other site other than BidsnBuys.

13. Buying and Bidding.

You the buyer have a legal commitment to fulfil the business deal with the person selling the item.

1. . If you buy any item via one of the fixed price systems,

Or, if at the finish of an auction you are the highest bidder and meet the lowest bid or reserve and include bids that become higher following a bona fide bid withdrawal, and your bid is acknowledged by the seller, but if the item in question is in the group listed Policy of Non Binding items then the sale is forbidden by law.

When you bid on any item that is listed on this site you consent to be bound by the conditions of sale incorporated in the items description providing that the conditions of sale are not in violation of the BidsnBuys user agreement. The retraction of bids are only allowed in exceptional circumstances, e.g. when the person selling the item alters the description after a bid has been made on that item, or a error has been made when submitting the details, or you are unable to validate the sellers identity. Our Retraction of a Bid Policy should make clear when retractions are allowed. Buyers should be certain they are legally able to bid and buy the items you bid for.

14. Permit.

BidsnBuys to allow the information that you provide, we are given a non restricted, continuous, around the world, unalterable, free from Royalties, permit to implement trademarks, database rights, copyrights that are contained in your information or in any media presently recognised. And you surrender all every entitlement that you have to the data you have given to the greatest degree permissible that the law allows

15.Your Information.

We will process and hold your information securely and the data you give us will only be used for the purpose it is intended for at no time do we rent or sell any information to third parties, no third parties have access to our customer data base at any time.

16. The rights of third party users.

This user agreement gives no rights to third parties to put into force any terms of this user agreement.

17. Insurance against Loss.

It is agreed by you that you will not make any claim or demand that will cause detriment to BidsnBuys, this is to include acceptable lawful fees, made by you or any third parties that may develop of your violation of our user agreement or any breach of a third parties rights or any laws that may apply.

18. Legal responsibility limitation.

Not anything in the BidsnBuys user agreement will eliminate or exclude our accountability for misrepresentation that is fraudulent, or in the case of fatality or any physical damage following our neglect or the neglect of any members of BidsnBuys staff. At no time are we legally responsible for financial loss this includes with no restriction, finances, agreements, investments business or otherwise, loss of income, or loss of nontangible value of business (goodwill), any loss of standing or reputation, any unusual roundabout or subsequent costs in what ever way they occur, this includes neglect developing because of or linked to the BidsnBuys user agreement.

BidsnBuys at no time have any liability of any description this includes negligence for the undertakings or the oversights of any suppliers of communication services or any errors or malfunctions to the equipment and systems they provide.

BidsnBuys legal responsibility to you or any other third parties in any situation is restricted to the payment you made to us for the cost of your listing fees.

19. Settling Disagreements.

Any disagreements involving you and another user of BidsnBuys are to be reported to your local police station, not us.

20. Data.

You and you alone are responsible for the information that you have made available to us and other users of the site BidsnBuys we only act as a channel for the information received this includes listing, feedback, bidding, registration and any subject matter that you may place on the site BidsnBuys.

21 There are no guarantees.

It is not guaranteed that this site will give continual or protected admittance and could be impeded by many issues beyond our control. This site and any other services we may offer are supplied on an �is� and �when available� basis. And all implied guarantees are disqualified to the degree allowed by law. This includes any other terms or conditions, if inferred by decree or not.

22. Cancellations

Under the Consumer Protection as soon as you have sent a form to us to sell your item you will not have the right to cancel any listing?

23. Authentication.

Bids Buys are not accountable or liable for the authentication of the rights of the seller to list on this site and to be able to sell the item. But we make every effort to make certain that items listed on this site, or the descriptions of the items listed do not contravene the trademark or copyright, or the rights of any third parties. If any one has reason to believe their rights have been breached notify the site and the offending item will be removed along with the seller of the item.

24. about your User ID for the site BidsnBuys.

When registration is complete you must choose a password and user ID and only

25. Bidsnbuys is not an auction site.

Bidsnbuys only acts as a place to buy and sell legal items, and only by registered

Users. Never at any time do we have the items for sale in our possession and the

listings on the site are not reviewed, we are not held liable for the quality, legality

or safety of any of the items found advertised on this site, and we do not have any

control over the accuracy of the descriptions of the items advertised. Never assume

that the import, export, sale, offer or purchase of any item is legal and valid because

it is advertised on this site. At no time are we accountable for making sure that a

transaction is completed by buyers and sellers. And you acknowledge that you are

responsible for your actions under any laws that apply to you.

26.Data Control.

BidsnBuys have no power over the details given by other users that are made obtainable through the site. You may become aware of information that is abusive, risky, incorrect or misleading. Please use common sense and care and at all times exercise fair and safe trading. We wish it also to be noted that there is a possibility that you could find your self dealing with people acting dishonestly or with juveniles. You the user consent to acknowledge and accept the dangers and risks and agree that BidsnBuys are in no way responsible for the actions of the users of this site

27. Items that are Restricted on this Site.

Never at any time may you sell, offer, buy or make bids on items that are not permitted

on this site. You will find the list under Restricted Items. We do not accept any

responsibility for the safety of any of the listed items advertised on our site. Never take

for granted that what you buy is not dangerous.

28. Legal agreement and the governing law.

The BidsnBuys user agreement is put together in agreement with the law in England. In the country that you live or that of any person you may be dealing with on the BidsnBuys site may have different laws that are relevant to your transaction with them in spite of what you have consented to with us at this time or with the user you are dealing with at a later date.

In your country the laws may differ from English law, this includes what can be legally be purchased, put up for sale or imported or exported. At all times you must act in accordance with all the laws that apply this includes international and domestic laws, legislations, decrees, and any regulations that may apply concerning you using our site and items you bid on, any listing you put on the site anything you may buy on our site or by getting a third party to participate illegally to buy items on this site.

As there is no feasible way to keep an eye on every business deal or the laws that

apply in every country it should not be taken for granted that you are permitted to do

the same as other users are doing or in any way we support or authenticate any

business deal even if you have made successful bids and sales before.

29. Bids that you are bound to.

Any seller who obtains even one bid at the fixed minimum price or over, or if the item is in a reserve auction, at or higher than the reserve price, are obligated to finish the deal with the buyer with the highest bid at the end of the listing, except if the item in question is found in the Policy of non binding items. Or if the person who is buying the item does not meet the stipulations of the sellers listing. E.g. method of payment, or if the person selling the item cannot validate identity of the buyer.

30. Over all view.

If any stipulations of the BidsnBuys user agreement is found to be void or not able to be enforced, they are to be removed and the stipulations that are left will be enforced. It is to be agreed by you as a member of the BidsnBuys site that all included agreements shall be without doubt allocated by BidsnBuys. Third parties in the occurrence of an amalgamation or any other occurrence, that you the user and BidsnBuys are freelance contractors and this user agreement does not produce affiliations, partnerships of any kind, member of staff relationships or associations of any other kind. Captions and titles are for identification purposes only and do not describe, regulate, interpret the range or the amount of the section described by the caption. If at any time we fail to take measures to a violation by a member of this site, it does not stop us taking action to following violations of the same or similar nature. The whole of this user agreement puts into place the comprehension and contract connecting us at BidsnBuys to its business issues and at no time will verbal clarification or verbal communication of data be given by any of the participants involved change the understanding of the BidsnBuys user agreement.

The BidsnBuys user agreement succeeds above any stipulations impressed by any users of this site.

32. All money/credits in your bidsnbuys account is non withdraw able, after money is added to you bidsnbuys account it can not be redeemed for cash, it can only be redeemed on our site,

You must comply with the current policy not the policy when you register we reserve the right to change the policy at any time and agreeing to this binds you to this contract past present and future
